Fair Housing
Every listing and message on OwnCarry is subject to the federal Fair Housing Act. Listings may describe the property and the terms — never a preferred kind of buyer. Preferences or limitations based on race, color, religion, sex (including sexual orientation and gender identity), disability, familial status, or national origin are prohibited and result in removal. The Equal Credit Opportunity Act applies the same principle to regularly extended seller credit. State and local laws may protect additional classes.
Truth in Lending (Reg Z) advertising
Advertising a down payment, payment amount, number of payments, or finance charge for consumer credit secured by a dwelling requires the ad to also state the down payment, the repayment terms, and the "Annual Percentage Rate" spelled out in full. OwnCarry listing pages display the cash price, down payment, term, and the APR supplied by the poster, and the posting flow enforces this when trigger terms are advertised. A true lease-option is generally not credit under Reg Z, but disguised financed sales may be recharacterized.
Seller financing (Dodd-Frank / SAFE Act)
Private parties financing the sale of a dwelling to a consumer face limits without a licensed mortgage loan originator: one property in 12 months (balloon permitted; fixed or 5-year-plus adjustable rate), or up to three properties in 12 months (no balloon, good-faith ability-to-repay determination, same rate limits). More than that — or financing as a business — generally requires a licensed MLO, and five-plus in a year can make the seller a "creditor" under the full ability-to-repay rule. Commercial and most land transactions are business-purpose credit outside these consumer rules, though state usury and licensing laws still apply. Several states separately regulate executory contracts (e.g. Texas Property Code Ch. 5, Subch. D).
